Know your rights!
Your printer or copier manufacturer cannot, by law, require you to use or purchase a particular brand of cartridge, just as your car dealer may not legally require only “original brand” parts be used to fix your car. A manufacturer cannot void your warranty simply because you exercise your right to choose your preferred brand of supplies. To enforce such a policy is in direct violation of the Sherman Antitrust Act of 1890, the Clayton Antitrust Act of 1914 and the Magnuson-Moss Warranty Improvement Act of 1975.
IBM vs. United States, a 1936 U.S. Supreme Court case, set the precedent. At the time IBM leased data-processing machines to customers with the requirement that they only use the tabulating cards manufactured by IBM. Customers were threatened with termination of their lease if they used cards produced by other manufacturers. The Supreme Court ruled that companies which engage in the practice of requiring or intimidating their customers into purchasing supplies or replacement parts from them exclusively create an illegal “tying agreement.” Tying agreements were found to be in violation of both the Sherman and the Clayton Antitrust Acts.
What this means to you: Your printer or copier manufacturer cannot void the warranty on your printer because you use a cartridge manufactured by someone other than them. Even though the printer manufacturer is not required to warranty repairs that are necessary as a direct result of using non-original brand cartridges, One Source Imaging does provide a full warranty that covers such repairs, up to full printer replacement.
The Sherman Antitrust Act of 1890 (Section 2) states: “Every person who shall monopolize, or attempt to monopolize, or combine or conspire with any other person or persons, to monopolize any part of the trade or commerce among the several States, or with foreign nations, shall be deemed guilty of a felony . . .”
The Clayton Antitrust Act of 1914 (Section 14) states: “It shall be unlawful for any person engaged in commerce, in the course of such commerce, to lease or make a sale or contract for sale of goods, wares, merchandise, machinery, supplies, or other commodities ¿ or fix a price charged therefor, or discount from, or rebate upon, such price, on the condition, agreement, or understanding that the lessee or purchaser thereof shall not use or deal in the goods, wares, merchandise, machinery, supplies, or other commodities of a competitor or competitors of the lessor or seller, where the effect of such lease, sale, or contract for sale or such condition, agreement, or understanding may be to substantially lessen competition or tend to create a monopoly in any line of commerce.”
The Magnuson-Moss Warranty Improvement Act of 1975 states: “(c) No warrantor of a consumer product may condition his written or implied warranty of such product on the consumer’s using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade or corporate name; except that the prohibition of this subsection may be waived by the commission if: 1. The warrantor satisfies the Commission that the warranted product will function properly only if the article or service so identified is used in connection with the warranted product, and 2. the Commission finds that such a waiver is in the public interest.” (United States Code Annotated Title 15 Commerce and Trade Chapter 50 Consumer Product Warranties 15 Section 2302)
Don’t be afraid to show this information to any service person or OEM representative who inhibits or threatens your right to choose your own cartridge supplier. Should a service person or OEM representative try to tell you your warranty will be voided, etc., simply tell them you would like them to state that in writing on their company letterhead and to be sure to date and sign the letter. It is unlikely that you will get the written statement you requested.

All of our value brand cartridges are warranted to be free of defects in both material and workmanship for the life of the cartridge. We will refund or replace any cartridge that is defective.
In addition, One Source Imaging provides a limited warranty against damage to your printer. Under normal use (including operation of printer equipment within specifications and recommended maintenance) our cartridges will not cause damage to any compatible laser printer, inkjet printer, fax machine, or copier. If our manufacturer seals and/or labels are broken or removed this limited warranty is null and void.
If a defect in a One Source Imaging cartridge causes your equipment to fail, we will reimburse you for the full amount of all service and repair necessary to repair it, including replacement if necessary. We reserve the right to replace equipment instead of repairing it. This warranty is dependent upon you contacting us prior to contacting an outside repair technician and upon you providing us with satisfactory evidence that the printer failure was due to a defect in our cartridge, including a written statement on the service company’s letterhead, dated and signed by the company’s field sales or service representative.
This warranty applies to the performance of One Source Imaging value brand (non-OEM) supplies. It is exclusive of all other warranties, express or implied, and is not to be associated with or affected by any OEM printer or supply warranties. Our liability shall be limited to the terms provided above.

By using our value brand or remanufactured products, you maximize savings while keeping your printer warranty intact. An equipment manufacturer cannot void your warranty because you used your preferred brand of supplies. The manufacturer does not (and is not legally allowed to) require that you use their brand of cartridge, just as your car dealer cannot require only original parts to be used to fix your car. They do, however, often carefully word their warranties to make it seem that you must use their cartridges.
